Irizarry allegedly fled his car with a knife in his hand and charged at the police following a brief automobile chase.

The body cam film shows Dial getting out of his car and walking up to Irizarry’s car while brandishing a weapon. “I will f— shoot you,” he can be heard shouting before he starts shooting Irizarry, who is seated in the front passenger seat.

Before the bullets are fired, Irizarry is heard being told by a policeman to show his hands. Dial pulled a close-range shot, firing six rounds.

Indeed, two firearms were found in Eddie’s car by the authorities. The family of Eddie Irizarry Sr. said that he utilized it, though, to unwind wire as part of his work as a technician.

On September 8, 2024, Dial was charged with five further counts in addition to first-degree murder and voluntary manslaughter.

Judge Wendy Pew, however, dropped the case on Tuesday after a preliminary hearing because there was insufficient evidence.

There was “disagreement” with the decision from the Philadelphia District Attorney’s Office.

The agency released a statement following the hearing saying, “In keeping with our oath to seek justice, we will move to have all criminal charges, including Murder, reinstated against this defendant.”

The criminal complaint against Dial has been refiled by the office on all charges since that time. A hearing on the application has been set for October 25 before the Common Pleas Court.
